TERMS OF SERVICE

1. Acceptance of Terms

FootballPools("the Service") is operated independently. A registered legal entity for FootballPools is being formed; these Terms will be updated when filing completes. By accessing or using FootballPools, you agree to be bound by these Terms of Service between you and FootballPools. If you do not agree to these terms, please do not use the Service.

2. Description of Service

FootballPools is an entertainment-focused platform for American football pools, operated independently. Pool formats include Survivor (pick one team a week to win outright), Pick 5 against the spread, and full-slate Pick All pools. Users can create or join a pool, make picks on game outcomes, and compete with friends, family and colleagues. The Service keeps score and presents standings; it is designed for entertainment and social engagement.

3. Fees and Payments

FootballPools Hosting Fees:

• Pools with 5 or fewer members are free
• Pools with more than 5 members are charged a hosting fee of $2.00 USD per additional member above the free limit
• Hosting fees are payable by the Pool Commissioner after the first round of the competition ends
• Failure to pay hosting fees within the grace period may result in pool deletion

Commissioner Entry Fees (User-to-User):

• Pool Commissioners may set optional entry fees for their pools
• FootballPools does not process, collect, or handle entry fee payments between users
• Entry fees are settled directly between the Pool Commissioner and pool members using external payment methods (Venmo, Zelle, PayPal, etc.)
• FootballPools is not responsible for any disputes, non-payment, or issues arising from entry fee arrangements between users
• FootballPools provides tools for Commissioners to track payment status, but does not guarantee or enforce payment collection

FootballPools is not a sportsbook and does not accept wagers. The Service does not:

• Accept, place, broker, or settle bets or wagers of any kind
• Hold, escrow, process, or transmit stakes, entry fees, or prize money between users
• Pay out winnings, or guarantee that any prize will be paid
• Connect to, integrate with, or accept payment from any sportsbook or gambling operator

About point spreads. Some pool formats are scored against a point spread. FootballPools displays a spread for each game as publicly available sports information, captured once before the week begins and then frozen so every member is scored on the same number. That spread is used solely to determine whether a pick was correct.

Displaying a spread is not an invitation to wager, a betting offer, a prediction, or advice of any kind. We do not accept money against it. Spreads are sourced from third parties and are provided "as is" — we do not warrant that any spread is accurate, current, or matches a figure published elsewhere, and the frozen spread governs scoring within a pool regardless of how the market later moves.

Any arrangement of prizes or stakes between pool members is strictly between those individuals and is not facilitated, endorsed, held, or managed by FootballPools. You are responsible for ensuring that your participation is lawful where you live; contests involving an entry fee and a prize are regulated differently from state to state, and some jurisdictions restrict or prohibit them.

4. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

5. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service
• Create multiple accounts to circumvent rules or restrictions
• Harass, abuse, or harm other users
• Use automated systems or bots to access the Service

6. Pool Commissioner Responsibilities

If you create a pool, you become its Commissioner and are responsible for:

• Managing pool membership and settings
• Ensuring pool members understand and follow these terms
• Moderating pool activity in a fair manner
• Paying the FootballPools hosting fee if your pool exceeds 5 members
• Collecting and managing any entry fees directly from pool members (FootballPools does not handle this)
• Resolving any disputes related to entry fees or prizes with your pool members

7. Data and Privacy

We collect minimal data necessary to provide the Service, including your email address and display name. We do not sell your personal information to third parties. Match data is sourced from publicly available information.

8. Intellectual Property

The FootballPools name, logo, and Service design are proprietary. NFL, National Football League, Super Bowl, and related marks are trademarks of the National Football League and its member clubs. Team names, logos, and related imagery are the property of their respective owners. FootballPools is not affiliated with, endorsed by, sponsored by, or connected to the National Football League, any of its member clubs, or any players association. Team names and imagery are used for identification, informational and entertainment purposes only.

9. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free operation
• Accuracy of game data, point spreads, or scoring (though we strive for accuracy)
• Availability during peak usage periods

10. Limitation of Liability

FootballPools and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to:

• Any disputes, losses, or issues arising from entry fee arrangements between Pool Commissioners and members
• Non-payment or fraud related to user-to-user transactions
• Loss of data, picks, or pool information

Our total liability for hosting fee disputes shall not exceed the amount of hosting fees paid.

11. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time through the account settings page.

12. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.

14. SMS Communications

Brand / Sender: FootballPools (legal entity registration in progress)

Program: FootballPools Verification SMS

Description: If you choose to receive your account verification code by text message during signup at https://footballpools.us/signup, FootballPools will send you a one-time verification code (OTP) via SMS to the mobile number you provide. These messages are transactional and tied directly to a signup attempt initiated by you.

Message frequency: Up to one verification code message per signup attempt. You will not receive recurring or marketing messages from this program.

Message and data rates may apply. Standard messaging rates from your carrier may apply to messages sent to or received from FootballPools. FootballPools does not charge a fee for the SMS service.

Carriers:Carriers, including but not limited to AT&T, T-Mobile, Verizon, and Sprint, are not liable for delayed or undelivered messages.

Help: Reply HELP to any message from FootballPools for assistance, or email support@footballpools.us.

Opt-out: You can opt out of SMS messages at any time by replying STOP to any message you receive from FootballPools. After replying STOP, you will receive one confirmation message and no further messages will be sent unless you opt back in.

Privacy: Phone numbers collected for SMS verification are used solely for sending the verification code and are not shared with third parties or used for marketing purposes. See our Privacy Policy for details.
